DMCA Policy for Gyro Bread

Gyro Bread respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (DMCA), the text of which can be found on the U.S. Copyright Office website at http://www.copyright.gov/legislation/dmca.pdf, Gyro Bread will respond expeditiously to claims of copyright infringement committed using the Gyro Bread service and/or the Gyro Bread website (the "Site") if such claims are reported to Gyro Bread's Designated Copyright Agent identified below.

If you are a copyright owner, or are authorized to act on behalf of one, or authorized to act under any exclusive right under copyright, please report alleged copyright infringements taking place on or through the Site by completing the following DMCA Notice of Alleged Infringement and delivering it to Gyro Bread's Designated Copyright Agent.

Filing a DMCA Notice of Alleged Infringement

To file a notice of alleged infringement with Gyro Bread, you must provide a written communication (by email is preferred) that sets forth the items specified below. Please note that you may be liable for damages (including costs and attorneys' fees) if you materially misrepresent that a product or activity is infringing your copyrights.

  1. Identify the copyrighted work that you claim has been infringed, or if multiple copyrighted works are covered by this notification, a representative list of such works.
  2. Identify the material that you claim is infringing (or to be the subject of infringing activity) and that is to be removed or access disabled, and information reasonably sufficient to permit Gyro Bread to locate the material (e.g., URL(s) of the material on the Gyro Bread Site).
  3. Provide your contact information, including your full legal name, mailing address, telephone number, and email address.
  4. Include a statement that you have a good faith belief that the use of the copyrighted material is not authorized by the copyright owner, its agent, or the law.
  5. Include a statement that the information in the notification is accurate, and under penalty of perjury, that you are the copyright owner or are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  6. Provide your electronic or physical signature (typing your full legal name is sufficient for electronic submissions).

Filing a Counter-Notification

If you believe that your material has been removed or disabled by mistake or misidentification, you may file a counter-notification with Gyro Bread by sending a written communication to our Designated Copyright Agent identified above, which includes the following:

  • Identify the material that Gyro Bread has removed or to which access has been disabled and the location (e.g., URL) at which the material appeared before it was removed or disabled.
  • Provide your name, address, and telephone number.
  • State that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside of the United States, for any judicial district in which Gyro Bread may be found.
  • State that you will accept service of process from the person who provided the original notification of alleged infringement or an agent of such person.
  • Swear under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  • Provide your electronic or physical signature (typing your full legal name is sufficient for electronic submissions).
